Jon was never an oathbreaker. He took notes wife and fathered no children. He left the Night's Watch on the show because his oath was to serve till death, and he did. After he was brought back he could have swore it again but chose not to. True, he let some wildlings through, but the Night's Watch was created to guard against the White Walkers, not the Free Folk.
