You can replace it with a public domain song, or mention the song. but if you keep the copyrighted ones you not only risk the story being reported,and potentially taken down, you also run the risk of someone contacting the copyright holders of the infringement, to which a Cease and Desist order be sent. Your account could also be removed if the admins decide to go that route. No, a disclaimer will not prevent the story being removed and profit is not needed for someone to be found guilty of copyright infringement. A disclaimer is seen as an admission of guilt, they are more for cases involving plagiarism. All sites have rules against copyright infringement for a reason.

This is by far the best OC (or should I say OCs) in Hetalia fanfic I have ever read. Amy has personality, and I really enjoy her. The characterization of the nations are pretty spot on. It's just great.
